The short version: FateFlap is a free tool that runs entirely in your browser — you build a wheel, spin it, and get a result, all on your own device; we never see or store your entries. It's a fairness and party tool, not a gambling product — no wagering, no stakes, no real payouts. We provide it "as is," without guarantees, and our liability is limited as described in §7. Our Privacy Policy explains what little data we do collect. This short version is just a summary — the full Terms below are what actually govern your use.

1. Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and ZIX DEV Inc, a Delaware corporation with its registered address at 1111B S Governors Ave STE 40023, Dover, DE 19904, United States ("ZIX DEV," "we," "us," or "our"). They cover your use of fateflap.com ("the Service").

By using the Service, you agree to these Terms. If you don't agree, please don't use it. You must be at least 13 (or the minimum age of digital consent in your country) to use the Service.

2. What FateFlap is

FateFlap is a free, browser-based spin-the-wheel decision picker and party game. You add entries, optionally weight them or add wildcard twists, spin a wheel, and get a result — Classic mode (repeat picks) or Elimination mode (knockout rounds to a single Survivor). No accounts, no sign-up, no payment.

Everything happens on your device. Your entries are processed inside your own browser; we never upload, see, or store them. See our Privacy Policy for how that works.

3. FateFlap is a fairness & party tool — not a gambling product

FateFlap does not offer, facilitate, or support wagering, betting, staking, or any game of chance for money or anything of monetary value. There is no way to deposit funds, place a bet, or withdraw a payout anywhere in the product. The "Prize drop" preset and any similar entry list are illustrative labels only (e.g. "$10," "JACKPOT") and do not represent, and can never be redeemed for, real money, credit, or any prize of value. Results are random entertainment for settling everyday decisions — choosing a name, a team, a turn order, or a fun outcome among friends — nothing more.

Non-affiliation. FateFlap is an independent product. It is not affiliated with, endorsed by, or sponsored by any other similarly-named wheel, game show, casino game, or franchise, whether or not it shares a similar name or concept.

4. Using the Service

We grant you a personal, non-exclusive, revocable license to use FateFlap for your own personal, educational, or business purposes, subject to these Terms.

Please don't:

• use the Service for real-money wagering, gambling, or any activity where a spin result determines a payout of money or a prize of monetary value;
• use the Service to harass, bully, or target a specific person via entry text designed to demean them;
• copy, reverse-engineer, decompile, or build derivative works from the Service's software, except where the law says we can't stop you;
• resell, sublicense, rent, or pass the Service off as your own product;
• remove or obscure any copyright, trademark, or other notice;
• use bots, scrapers, or other automated tools to access, overload, disrupt, or probe the Service;
• try to get around any technical limit we put in place;
• use the Service for anything unlawful, or to violate someone else's rights.

We may suspend or block access for anyone we reasonably believe is breaking these rules.

5. Your entries, your rights

You own whatever you type into FateFlap. Because processing happens on your own device, we never receive, see, or store it — there's nothing for us to claim any right to. You're responsible for your own entries and confirm that using them doesn't break the law or violate anyone else's rights.

6. Our intellectual property

The Service itself — its software, design, and the "FateFlap" name and branding — belongs to ZIX DEV Inc or our licensors. These Terms don't transfer any of that to you; you get only the license in §4.

Open source. FateFlap is built on open-source software and fonts, including React (MIT), and self-hosted Inter / JetBrains Mono / Noto Sans & Naskh Arabic fonts under the SIL Open Font License. See our third-party notices page for the full list and required credits.

7. No warranty; limitation of liability

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind — express, implied, or statutory — to the maximum extent the law allows. We don't guarantee the Service will be uninterrupted, error-free, or always available, or that a spin outcome will be free of any bug.

To the maximum extent the law allows, ZIX DEV Inc is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service. Our total liability for any claim is capped at the greater of (a) what you paid us for the Service in the 12 months before the claim arose (currently $0, since the Service is free) or (b) US$100. *(This numeric floor is flagged for outside-counsel confirmation.)*

Some places don't allow excluding certain warranties or limiting liability this way, so some of the above may not apply to you, and you may have additional rights.

8. Analytics & other third-party services

We use privacy-friendly, cookieless analytics (self-hosted Plausible) to understand how the Service is used — it sets no cookies, collects no personal data, needs no consent banner, and never touches your entry content. See our Privacy Policy §4. FateFlap shows no ads and includes no advertising integration in this version.

9. Trademarks & independence

FateFlap is an independent product operated by ZIX DEV Inc, not affiliated with, endorsed by, or sponsored by any other wheel, decision-picker, or game-show product referenced anywhere for comparison. "FateFlap" and the fateflap.com branding are ZIX DEV Inc's, used under common-law rights; we do not currently claim any US federal trademark registration in this name.

10. Changes; ending your use

We may add, change, or discontinue any part of the Service at any time, since it's offered free of charge. We may also update these Terms; continuing to use the Service after an update means you accept the revised Terms. You can stop using FateFlap at any time — there's no account to close and nothing to cancel.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute is subject to the exclusive jurisdiction of the state or federal courts located in Delaware, United States. These Terms don't include a mandatory-arbitration or class-action-waiver clause.

12. General

These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and ZIX DEV Inc about the Service. If any part turns out to be unenforceable, the rest still stands; our failure to enforce a provision isn't a waiver; you can't assign these Terms to someone else, but we may.
